Datum Site Care Terms of Service

Last updated: October 25, 2026

These Terms are a contract between you ("Client," "you") and Datum Operations LLC, a New York limited liability company ("Datum Operations," "we," "us"). You accept them at checkout by ticking one required, unchecked box that also confirms the automatic renewal (Section 3) and that you're buying for a business (Section 1). After checkout, we email you your Order Form to confirm your plan and details (Section 2). Your Order Form (Exhibit 1), our Domain Policy and Acceptable Use Policy (both in these Terms, Sections 17 and 18), and the Datum Privacy Policy are part of these Terms.

1. The Service

We design, host, and maintain a small-business website, landing page, or funnel ("Site"). We host your site and store its code with third-party hosting and code-storage providers we choose. We may change providers without changing your service. Payments run through our payment processor. Domain management (DNS and related access to point your domain at the Site) is included. You own your domain; see the Domain Policy (Section 17) and Section 11. Your use of the Service must follow our Acceptable Use Policy (Section 18). Your plan and its scope are listed in your Order Form.

For businesses only. The Service is offered only to businesses, for business use. By signing up, you confirm that you're acting for a business, not as a consumer for personal, family, or household purposes. We may decline any sign-up that isn't for a business.

2. Plan and pricing

During the pilot, Datum Site Care is $39 a month, billed monthly and renewing until you cancel. There's no annual plan.

  • Standalone: a one-time $199 setup fee plus $39 a month.
  • Added to a Datum Operations CRM plan: no setup fee, $39 a month. If your CRM plan includes Site Care, it's covered by that plan's fee.

The Starter plan includes 1 to 3 pages, 30 minutes of edit time a month (Section 5), form submissions sent to your email, a tap-to-call button, and a link to your Google Business Profile if you have one.

Add-ons:

Item Price
Extra page from an existing template (about 1.5 hours of work or less) $79 one-time
Bigger page, custom page, or redesign Written quote before work starts
Edit time beyond your monthly allowance $25 per 15 minutes
New form or integration $99 and up (written quote)

Prices exclude any sales tax that applies. Third-party subscriptions (for example your domain renewals or any paid tools you choose) are billed to you by those providers and aren't included. How it works. You pay at checkout, then we collect your details (intake), build your Site, send you previews to approve, and launch it once you approve in writing.

What you pay at checkout. Standalone: the $199 setup fee plus your first month ($39). Add-on: your first month ($39), or as shown on your CRM plan invoice. Your plan renews every month after that, starting one month after checkout, whether or not your Site is live yet. It keeps renewing until you cancel (Section 3).

No refunds. Fees you've already paid aren't refundable, in whole or in part. That includes the $199 setup fee, your first month, months before your Site launches, and partial months, and it applies even if you cancel before your Site launches or never approve it. Cancelling stops future renewals. You won't be charged again, and your Service runs to the end of the month you've paid for. The only exceptions are these: (a) a charge that goes through on or after the day you cancel (Section 3), (b) a price increase you cancel after (Section 3), (c) if we end the Service (Section 11), (d) a charge we made in error or that you didn't authorize, and (e) anywhere else the law requires a refund.

  • If you cancel mid-build. Billing stops (Section 3). You keep your own content from the previews, but you don't get a license to use our design or code.

If you don't approve. We never launch your Site without your written approval. If you don't approve or reply, your plan keeps renewing until you cancel at https://www.datumoperations.com/site-care/cancel. Cancelling stops future charges. We'll email you a reminder if we haven't heard from you 30 days after a preview. There is no separate domain fee. We never buy, register, renew or bill your domain.

When these Terms start. You accept these Terms at checkout, before we start any work. From then on, these Terms cover intake, the build and preview period too, including ownership of your content and our templates and code (Section 6), data handling (Section 7), the limits on liability (Section 10), and your indemnity (Section 12). Your monthly plan, billing, and automatic renewal start as described in "What you pay at checkout" above. If you cancel before launch, the rules above apply, you don't get a license to use the preview design or code, and the surviving sections in Section 11 still apply.

Revision rounds before launch. Every Site Care plan includes 2 revision rounds on your preview before launch.

  • What a round is: one consolidated list of changes from you, sent in one email, on the current preview. We confirm the list back to you before we start.
  • What a round can include: text and photo changes, reordering existing sections, swapping between the template's own section variants, and color or font tweaks that stay within the agreed brand direction.
  • Our mistakes don't count. Fixes to anything we got wrong never use up a round.
  • When a round ends: if we don't hear back within 10 business days after we send a preview, that round is closed.
  • After round 2: further changes are $25 per 15 minutes, quoted before we start, or they can wait until your Site is live and come out of your monthly edit time (Section 5).

New work. "New work" is anything beyond the pages and scope agreed in your Order Form, including new pages, new section types the template doesn't have, new features, new forms or integrations, and a redesign (a different template, layout, or structure) after you've accepted round 1. New work isn't included in setup, revision rounds, or edit time. We quote it in writing before anything starts and bill it at the add-on rates above ($79 for an extra template page, $99 and up for a new form or integration, a written quote for anything bigger, and $25 per 15 minutes for small changes).

Not included (v1): e-commerce, text messages or calls (Section 16), automated email follow-up, and CRM consulting. CRM consulting, CRM strategy, and ongoing CRM retainers are available only under a separate written agreement, never as part of these Terms or your edit time.

3. Automatic renewal (please read)

  • Your plan renews automatically until you cancel. Your plan renews every month at $39/month, the price in your Order Form. We charge the card on file on your renewal date.

  • Cancel any time with our cancel form at https://www.datumoperations.com/site-care/cancel (no login needed) or by emailing billing@datumoperations.com. You don't need to give a reason, and you don't need to call. Your cancellation counts from the moment we receive it, and we'll confirm it in writing from billing@datumoperations.com within 1 business day. Cancel on or before your renewal date and that charge stops: you won't be charged for the next term. If a charge goes through on the day you cancel, or after you cancel, we'll refund it in full. No retention gauntlet.

  • Add-ons. Cancelling Site Care doesn't cancel your CRM plan, and cancelling your CRM plan doesn't cancel Site Care unless you ask. If Site Care was included in your CRM plan, it ends when that plan ends.

  • Monthly: cancellation takes effect at the end of the paid month. No further charges, no partial-month refund.

  • We email a confirmation at signup with these terms and how to cancel, and another when you cancel.

  • Price and renewal-term changes. We'll email you a clear notice of any price increase or other material change to these renewal terms between 5 business days and 30 days before it takes effect, with how to cancel. If we raise your price, you can cancel within 14 days after your first charge at the new price, and we'll refund the unused days of the period that charge covered, prorated by day.

  • At checkout we show these terms next to the pay button. Checkout has one required, unchecked box: "I agree to the Datum Site Care Terms, I'm buying for a business, and I understand my plan renews automatically every month at $39 (plus any tax) until I cancel." The full renewal disclosure sits right next to the pay button. We don't take payment until the box is ticked.

4. Annual plans. Not offered during the pilot.

5. Included edit time and approval

  • Your plan includes 30 minutes of edit time each month. We track it in 15-minute blocks. Unused time doesn't roll over, and the counter resets on your billing date.

  • What counts as an edit: changing existing text, prices, hours, photos, links, testimonials, and small fixes to existing form fields.

  • What isn't an edit (quoted in writing before work starts): new pages ($79 for a template page of about 1.5 hours or less; anything bigger is quoted), new forms or integrations ($99 and up), redesigns, and new features. Edit time beyond your allowance is $25 per 15 minutes, and we'll tell you before we go over.

  • CRM work is never an edit. CRM setup, pipelines, lists, workflows, reports, imports, cleanups and CRM advice aren't covered by edit time. They're available only as work under a separate CRM consulting agreement.

  • When you pay. Setup (standalone only) and the 2 included revision rounds are paid at checkout, as described in Section 2. Any new work, add-on, or change after round 2, whether during setup or after your Site is live, is quoted in writing and paid before we start it.

  • How edits go live: send edit requests in writing to hello@datumoperations.com. Send changes in one email per batch; we do up to 2 batches a month inside your 30 minutes. We build each edit on a private preview link and check it before it's published. You can ask to see the preview first. Our target for small edits is 1 business day (business days, Buffalo, NY time), counted from when we confirm your list back to you. Targets aren't guarantees.

  • Standing approval scope. These edits can go live without a separate sign-off each time, as long as you asked for them in writing, they fit your remaining monthly edit time, and they pass our checks:

  • Replacing or correcting text that already exists on an existing page: business details, prices, hours, service lists, service areas, links, testimonials you supplied word for word, and typo fixes.

  • Swapping a photo for one you supplied, in an existing image slot on an existing page.

  • Undo. We log every standing-scope edit and tell you when it's live. Reply "undo" within 7 days and we'll put it back. We'll also roll it back if we find an error.

  • Everything else needs written approval first. Any edit outside the standing scope, including new pages or sections, layout or navigation changes, removing pages, redesigns, changes to forms, the privacy notice or other legal text, and anything that needs a quote, is published only after Datum Operations LLC approves it in writing, and after you've approved any quote.

6. Your content

You own your content: text, logos, photos, and your leads and customer data, including your contact lists, CRM records, and consent records ("Client Content"). You give us a limited license to host, copy, adapt, and display it only to run your Site. You promise you have the rights to everything you send us, including photos. Datum Operations keeps ownership of its templates and code. While you're subscribed, you have a license to use them on your Site. When your plan ends, you get a static export of your Site and Client Content (Section 11), and a non-exclusive, perpetual, royalty-free license to use, host and change the template code in that export for your own business's website. You may not resell, sublicense or reuse it for other businesses' sites.

Images: we use only images you supply (which you warrant you're licensed to use) or stock we license for your Site. Stock licenses may not transfer to you if you leave; we'll tell you which images those are.

7. Data processing

Roles. For personal data your Site collects from visitors (contact-form name, email, phone, and message), you're the controller (the "business") and Datum Operations is your processor (the "service provider").

We'll: 1. process visitor data only to run your Site and as you instruct, which includes sending form submissions to you by email; 2. not sell or share it, or use it for our own marketing or any other customer; 3. keep it confidential and use reasonable security, including two-factor authentication on the accounts we use for your Site; 4. use only the service providers listed in your Site's privacy notice and our Datum Privacy Policy, and tell you before adding new ones; 5. help you answer privacy requests from your visitors; 6. tell you without undue delay after we learn of a breach affecting it; 7. not send automated emails, texts, or calls to your leads; and 8. delete or return any copies we hold within 30 days after your plan ends, unless the law requires us to keep them.

No sensitive data. Forms we build collect only name, email, phone, and message, plus an optional unchecked marketing-consent box if you ask for one. We won't add, and you won't ask for, fields for health information, Social Security or other government ID numbers, financial account or card numbers, children's data, or other sensitive data. If your business is in a regulated field (for example health care, finance, or insurance), tell us before setup; we may decline or require extra terms.

Onboarding: verify your form inbox. At onboarding, our hosting provider sends a "verify this address" email to the inbox you choose for form submissions. We'll tell you the sender name when we send your setup steps. Click the link in that email once to confirm the address. Your form can't deliver to that inbox until you do. If you change your form inbox later, the new address needs the same one-click verification.

Your privacy notice. You're responsible for having a lawful basis and a privacy notice for what your Site collects, and for any consent you need before you market to leads. We'll provide a starter Client Site Privacy Notice and link it at each form. You're the business named in it.

8. Accessibility

We build on templates designed with WCAG 2.1 AA guidelines in mind and fix accessibility issues we're told about within a reasonable time. We don't guarantee your Site is fully accessible or that it complies with the ADA, especially content you add. Accessibility lawsuits are a real risk for small-business sites.

9. No uptime guarantee

We don't guarantee any uptime or that the Site will be error-free. Our hosting and network providers can have outages outside our control. No service credits.

10. Disclaimer and limitation of liability

EXCEPT AS THESE TERMS SAY, THE SERVICE IS PROVIDED "AS IS," AND WE DISCLAIM IMPLIED WARRANTIES TO THE EXTENT THE LAW ALLOWS. WE DON'T PROMISE RANKINGS, LEADS, OR REVENUE.

TO THE EXTENT THE LAW ALLOWS: NEITHER PARTY IS LIABLE FOR LOST PROFITS, LOST REVENUE, LOST DATA, OR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. WE AREN'T LIABLE FOR LOST LEADS, LOST OR DELAYED INQUIRIES, LOST SALES OR BUSINESS OPPORTUNITIES, LOST PROFITS OR REVENUE, OR THE COST OF REPLACEMENT LEADS OR ADVERTISING, WHETHER THOSE LOSSES ARE CHARACTERIZED AS DIRECT, GENERAL, INDIRECT, OR CONSEQUENTIAL, AND EVEN IF WE WERE TOLD THEY WERE POSSIBLE.

OUR TOTAL LIABILITY FOR ALL CLAIMS IS CAPPED AT THE GREATER OF (A) THE FEES YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) $100. These limits don't apply to gross negligence, willful misconduct, your payment obligations or your indemnity, or where the law won't allow them.

11. Domains, termination, and exit

  • You own your domain. You're the registrant in your own registrar account. Datum Operations never registers domains for you, never lists itself as registrant, and never fronts or bills renewals. We get only the DNS or manager access needed to point your domain at the Site. Details are in the Domain Policy (Section 17).

  • You can cancel anytime (Section 3).

  • We can suspend for nonpayment after 14 days, or for AUP violations or legal risk, and terminate after 30 days unpaid, after written notice, or for serious violations. We can also end the Service for any reason with 30 days' notice and a prorated refund of prepaid fees.

  • On exit, within 5 business days of your request or of plan end, we hand over a static export of your Site and Client Content, remove our DNS or manager access, return any domain records or settings we have for your domain, and help you repoint DNS if you ask. No domain fee, buyout, or unpaid-renewal charge. Domains follow the Domain Policy (Section 17).

  • Sections 6, 7, 10, 12, 14, and 15 survive.

12. Indemnity

You'll defend and indemnify Datum Operations against third-party claims arising from your Client Content (including images), your products and services, the messages you send to people who contact you, your contact lists and consent records, your use of any third-party account you own, and your breach of these Terms or the AUP. We'll notify you promptly and cooperate.

13. Changes

We'll email you notice of material changes to these Terms between 5 business days and 30 days before they take effect. If you don't agree, cancel before they take effect.

14. General

New York law governs, without regard to conflict rules. Disputes go to the state or federal courts in Erie County, New York, except either party may use small claims court. These Terms and your Order Form are the entire agreement; unenforceable parts are severed. A separate CRM consulting agreement, if we sign one, governs only the work it describes. Notices go to your account email and to hello@datumoperations.com. Notices about charges, refunds, failed payments, receipts or cancellation go to billing@datumoperations.com.

15. Third-party platforms

Your Site and plan rely on platforms we don't control, including our hosting, code-storage and payment providers. We aren't responsible for their changes, outages, suspensions, price changes or removal of free features. Accounts you own, like your domain registrar account, are under your own agreements with those providers.

16. No text messages or calls

The Service doesn't include text messages, calls, or voice messages to your leads or anyone else, and we won't set any up. SMS isn't offered in this version. If you turn on texting or calling yourself, that's outside the Service and your indemnity in Section 12 applies.

17. Domain Policy

17.1 Your domain is yours

Your domain is registered in your name (or your business's name), in your own account with the registrar you choose. You're the registrant and you own the registration. Datum Operations never registers a domain for you, never lists itself as registrant, and never keeps a domain in an account Datum Operations controls.

17.2 If you don't have a domain yet

We'll walk you through buying one in your own name, in your own account, with your own payment method. We don't buy it for you and we don't keep your registrar login.

17.3 What access we need

While you're subscribed, you give us only the access needed to point your domain at your Site, such as a DNS or domain-manager role that doesn't transfer ownership. This is included in your plan. There's no domain fee.

17.4 Renewals and cost

You pay your registrar directly for the domain and its renewals. We never pay, invoice or mark up domain costs. If we can see your renewal date, we'll remind you about 30 days before it, but keeping the domain renewed is your responsibility.

17.5 When you leave

Within 5 business days of your request or of your plan ending, we remove our access, return any domain records or settings we have, and help you point the domain somewhere new if you ask. No fee to leave. Unpaid fees never hold up your domain or the return of access.

17.6 If your plan is unpaid

We may take your Site offline, but we won't touch your domain registration.

18. Acceptable Use

This policy applies to every Site, page, form, domain and message connected to Datum Site Care. If something breaks it, we may remove the content, suspend the Site or end the Service, as our Terms describe.

18.1 Not allowed

  • Illegal content, or promoting illegal goods or services

  • Child sexual abuse material (we report it as federal law requires)

  • Content that infringes copyright, trademarks or other rights, including photos you don't have the rights to

  • Phishing, malware, scams, fake reviews, pyramid schemes, or deceptive claims (including unsupported health, earnings or licensing claims)

  • Harassment, threats, doxxing, or hate content targeting protected groups

  • Non-consensual intimate imagery, or adult content

  • Regulated goods or services (gambling, weapons, drugs, medical or legal services) without the licenses they need and our written OK

  • Collecting sensitive data through Site forms (health information, Social Security numbers, financial account numbers)

  • Attacking, scanning or overloading our systems or anyone else's

18.2 Your marketing

If you email people who contact you through your Site, follow the CAN-SPAM Act: accurate headers and subject lines, your postal address, and a working opt-out you honor within 10 business days. FTC guide: FTC CAN-SPAM guide

Don't send marketing texts or make autodialed or prerecorded calls without the consent the TCPA requires (47 U.S.C. 227). The Service doesn't include texts or calls.

No bought, rented or scraped contact lists.

18.3 Copyright and trademark complaints

Send complaints to hello@datumoperations.com or Datum Operations LLC, Mailing address: 4498 Main St Suite 4 #1613, Buffalo, NY 14226. Include your contact details, the work or mark, the URL of the material, and a statement that you believe in good faith the use isn't authorized. We'll review it promptly, remove or disable material that infringes, and tell the client. A client who thinks something was removed by mistake can reply with an explanation, and we'll review it. Repeat infringers lose the Service.

18.4 Reporting abuse

Report abuse to hello@datumoperations.com. We may investigate and cooperate with law enforcement.
